Costco, which has become a household name since 2013, is facing a legal challenge over its $2.5 million erectile dysfunction drug, which has cost more than $1.6 billion in U. S. prescriptions, and is facing a $4.5 million fine, U. District Judge Bonnie Craig said Wednesday.

“A prescription drug is the drug the FDA is required to approve to treat a condition,” said Dr. Steven Nissen, director of the agency’s Center for Drug Evaluation and Research.

“This is one of the largest and most aggressive enforcement efforts in the agency’s history,” Nissen said.

The FDA said in a statement that it was “reviewing the application for a Viagra prescription by the Food and Drug Administration and will provide a response within 30 days.”

At the time, the drug had not been approved for sale and was not for use under the brand name Pfizer, according to the agency.

In 2013, the FDA approved a new formulation of erectile dysfunction drug, Viagra, for use only on the basis of clinical trials and a prescription, the agency said.

Viagra is also sold under a variety of brand names including “Sildenafil,” “Viagra Super,” and “Viagra.”

But Pfizer said it has not approved Viagra for sale to women and is awaiting FDA approval for its use in men.

In April, Viagra was the first pill to be approved to treat erectile dysfunction in women, said Dr. John Vistal, a clinical professor at the University of Pennsylvania. The new Viagra formulation, Vigorex, has not yet been approved for sale.

The FDA had earlier rejected a similar drug, Viagra Super, based on its results of a clinical trial, and had ruled that it was a drug that should not be approved for sale, the FDA said.

The FDA said it has “concluded no evidence” that Viagra Super is a drug used to treat impotence.

Vistal said the FDA has issued a warning to physicians and patients that the drug is not approved for use by women.

Viagra was approved for use only in men, and the drug is also prescribed off-label for the treatment of erectile dysfunction, Vistal said.

Viagra is the first pill to be approved for women to treat erectile dysfunction in men, the FDA said.

The FDA also said it has not approved Viagra for use in women for the treatment of impotence, which the FDA had not approved for sale to women for treatment of erectile dysfunction.
